It has been compared to drunk driving, and is perhaps more dangerous.<span style="mso-spacerun: yes;">  </span></span></span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 36pt; margin: 0pt;"><span style="font-family: Times New Roman;"><span style="font-size: small;">A new group, called FocusDriven has developed a program that is patterned after the Mothers Against Drunk Driving.<span style="mso-spacerun: yes;">  </span>This program grew out of the Summit on Distracted Driving which was held last year in Washington, D.C. The Summit was sponsored by the U.S. Department of Transportation.<span style="mso-spacerun: yes;">  </span>FocusDriven is urging people to break the habit of texting while driving.<span style="mso-spacerun: yes;">  </span>They have indicated that texting is similar to any other addictive behavior.<span style="mso-spacerun: yes;">  </span>People have become addicted to their cell phones.<span style="mso-spacerun: yes;">  </span></span></span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 36pt; margin: 0pt;"><span style="font-family: Times New Roman; font-size: small;">I hope that FocusDriven is as successful as MADD has been in pressuring legislatures and <a href="http://">spear heading changes in laws against drunk drivers that cause fatal automobile accidents</a>. </span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 36pt; margin: 0pt;"><span style="font-family: Times New Roman; font-size: small;">Safe driving is something that we all should be concerned with.<span style="mso-spacerun: yes;">  </span>Distracted driving is not safe driving.<span style="mso-spacerun: yes;">  </span>Initially FocusDriven will be operated as an army of people traveling the country helping to convince people to put their cell phones away while they are behind the wheel of a car. </span><span style="font-family: Times New Roman;"><span style="font-size: small;">The group is led by Jennifer Smith whose mother was killed by a driver who was talking on a cell phone in 2008.<span style="mso-spacerun: yes;">  </span></span></span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 36pt; margin: 0pt;"><span style="font-family: Times New Roman; font-size: small;">There are numbers and statistics to support the statement that distracted driving has become a national epidemic.<span style="mso-spacerun: yes;">  </span>In 2008, 5,870 people lost their lives in crashes reported to police in which at least one form of driver distraction was listed on the police report as a cause of the accident.<span style="mso-spacerun: yes;">  </span>An additional 515,000 people were injured in these accidents.<span style="mso-spacerun: yes;">  </span>Distracted driving, as listed on a police accident report, is not just texting while driving.<span style="mso-spacerun: yes;">  </span>It<span style="mso-spacerun: yes;">  </span>also includes other forms of distraction such as:</span><span style="font-family: Times New Roman; font-size: small;"> </span></p>

<p class="MsoNormal" style="line-height: 200%; margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>Believe it or not the less than 20 age group has the highest proportion of distracted driving.<span style="mso-spacerun: yes;">  </span>I say this tongue in cheek. It is obviously no surprise. This group encompasses 16 percent of the accidents caused by distracted driving.<span style="mso-spacerun: yes;">  </span>I know this statistic is not surprising but there is good news.<span style="mso-spacerun: yes;">  </span>The percentage drops to 12 percent for the ages 20 through 29.<span style="mso-spacerun: yes;">  </span></span></span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 36pt; margin: 0pt;"><span style="font-family: Times New Roman; font-size: small;">Statistics show that a driver that uses a handheld device is four times more likely to get in a crash.<span style="mso-spacerun: yes;">  </span>We just need to put the cell phones down.<span style="mso-spacerun: yes;">  </span>It is the hope that FocusDriven will be a valuable resource for those who have lost loved ones as a result of an accident involving texting while driving and other distracted driving.<span style="mso-spacerun: yes;">  </span><a href="http://www.etrucker.com/apps/news/article.asp?id=84418">They will also focus on prevention much as the Mothers Against Drunk Drivers have</a>.</span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>Additionally the Department of Transportation has put an emphasis on putting an end to distracted driving.<span style="mso-spacerun: yes;">  </span>It is a top priority for them.<span style="mso-spacerun: yes;">  </span><a href="http://www.distraction.gov/">They have launched a federal web site</a></span></span><span style="font-family: Times New Roman; font-size: small;">.<span style="mso-spacerun: yes;">  </span>This web site has information on distracted driving.<span style="mso-spacerun: yes;">  </span>Use these resources to educate yourself. If you text while driving get information that will help you stop. If you know someone who has a problem, give them this information. It could save a life.</span></p>

			<content:encoded><![CDATA[<p class="MsoNormal" style="line-height: 200%; text-indent: 0.5in; margin: 0in 0in 0pt;"><span style="font-family: Times New Roman; font-size: small;">I had to travel to Lexington last week.<span style="mso-spacerun: yes;">  </span>As I was driving east on I-64 I saw a sign that read “52 deaths on Kentucky roads this year”.<span style="mso-spacerun: yes;">  </span>We have all seen these electronic signs that dot the interstates in Kentucky. My immediate thought was it’s not even the end of January and there have been 52 deaths on Kentucky roads due to auto accidents!<span style="mso-spacerun: yes;"> This is 52 fatal accidents. </span>I wonder what the causes of these deaths were.<span style="mso-spacerun: yes;">  </span>I was on my way to Lexington to file a lawsuit in a case where my client had been t-boned by a young teenage girl who was texting on her cell phone. She did not see the red light, ran it and slammed into the side of my clients’ car.<span style="mso-spacerun: yes;">  </span>Unfortunately, the consequences were severe. My client suffered a traumatic brain injury with a permanent memory problem as a result of this accident.</span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; margin: 0in 0in 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>I can’t believe that nothing has been accomplished in Kentucky to prohibit texting while driving. It is running rampant on Kentucky roadways, whether you are in Louisville or Lexington.<span style="mso-spacerun: yes;">  </span>There are so many people, not only teenagers but adults, on cell phones and being distracted by other means.<span style="mso-spacerun: yes;">  </span>This is making the highways more and more dangerous.</span></span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 0.5in; margin: 0in 0in 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">Last week the Transportation Department announced<a href="http://www.nytimes.com/2010/01/27/technology/27distracted.html?"> a new rule that prohibits interstate commercial truckers and bus drivers from sending text messages while they are operating their vehicles</a>.<span style="mso-spacerun: yes;">  </span>Those drivers who break this rule will face civil or criminal fines that could go up to $2,750.00.<span style="mso-spacerun: yes;">  </span>This rule became effective immediately.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 0.5in; margin: 0in 0in 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">Texting while driving is just one of the problems that should be addressed.<span style="mso-spacerun: yes;">  </span>Many truckers use computers while driving that are required by the companies.<span style="mso-spacerun: yes;">  </span>These are dash mounted. As everybody knows multitasking makes driving more dangerous.<span style="mso-spacerun: yes;">  </span></span></span><span style="font-family: Times New Roman; font-size: small;"> </span></p>
<p class="MsoNormal" style="line-height: 200%; text-indent: 0.5in; margin: 0in 0in 0pt;"><span style="font-family: Times New Roman; font-size: small;">I applaud the transportation department for making this rule.<span style="mso-spacerun: yes;">  </span>I hope that the states that have not instigated bans on texting while driving will do so in the near future.<span style="mso-spacerun: yes;">  </span>It will definitely save lives.<span style="mso-spacerun: yes;">  </span>Hopefully this will help cut down on the 52 deaths that have occurred this year on Kentucky highways.<span style="mso-spacerun: yes;">  </span>This is too many deaths from traffic accidents. Whether they are car accidents or truck accidents we need to take whatever steps we can to prevent them from occurring<span style="mso-spacerun: yes;">  </span>in the future. The National Transportation Department has taken a big step. Will Kentucky be next?</span></p>

Believe it or not they may not tell the truth. <span style="mso-spacerun: yes;"> </span>I have had to decline representing people in the last few weeks because:</span></p>

This witness claims that Sarah struck the car in front of her before she was rear ended.<span style="mso-spacerun: yes;">  </span>The impact from behind was definitely more severe and we will be able to collect on the claim.<span style="mso-spacerun: yes;">  </span>However, the adjuster wants to deduct for Sarah&#8217;s contributory negligence. He is arguing that Sarah is partly to blame for her injuries, based on the witness statement. <span style="mso-spacerun: yes;"> </span>This may in fact occur. It is a jury issue. But Sarah has a fighting chance. She was on the ball enough to get the names of two independent witnesses who were not listed on the police accident report. They were on the front porch of the house next to where the accident happened. They observed the accident and can verify that Sarah did not run into the car in front of her until she was propelled into that car by the rear impact. </span></span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>

How you can avoid serious automobile accidents is another topic I blog on.<span style="mso-spacerun: yes;">  </span>A tragic and unfortunate accident last weekend reminds me that there are also auto accidents that occur after your car breaks down. Traffic accidents occur while a vehicle is disabled on the road.<span style="mso-spacerun: yes;">  </span>Visibility is a key factor in your safety after a car breaks down.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"><a href="http://www.mikeschaferlaw.com/blog/david-meredith-and-omar-lopez-killed-in-kentucky-accident.cfm">David Meredith and Omar Lopez were killed </a>after they were hit by a pickup truck on Washburn Avenue in rural Jefferson County, Kentucky.<span style="mso-spacerun: yes;">  </span>This accident occurred after Meredith and Lopez’s vehicle had been in a minor rear-end collision on Washburn Avenue.<span style="mso-spacerun: yes;">  </span>Apparently the men were standing behind their truck after the accident and blocking the taillights. This made it difficult for the vehicle coming from behind to see the car in the road.<span style="mso-spacerun: yes;">  </span>Additionally there was fog in the area. This made visibility even more of an issue.</span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-spacerun: yes;"> </span>Any time you’re on the road visibility is something you should be aware of.<span style="mso-spacerun: yes;">  </span>This is the case whether you are a pedestrian, a bicyclist, or a disabled motorist.<span style="mso-spacerun: yes;">  </span>You need to make yourself visible.<span style="mso-spacerun: yes;">  </span>Bicyclists have reflectors and bright-colored jerseys that some would say make us look ridiculous.<span style="mso-spacerun: yes;">  </span>Runners wear vests to make them more visible if they are jogging on the road in the early or late hours of the day.<span style="mso-spacerun: yes;">  </span>The occupants of a disabled vehicle need to take precautions to make that car visible on the roadway.<span style="mso-spacerun: yes;">  </span>Reflective triangles should be placed behind the car. You can purchase them at almost any automotive store. They should always be used.<span style="mso-spacerun: yes;">  </span>Emergency flashers should be turned on.<span style="mso-spacerun: yes;">  </span>Do anything you can do to make yourself more visible.<span style="mso-spacerun: yes;">  </span>If you do not take these precautions drivers coming up on the accident scene or on you may not have a chance to avoid a tragic accident.</span></span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>A few years ago I represented a truck driver in what I would call a freak accident.<span style="mso-spacerun: yes;">  </span>A semi tractor-trailer was traveling down I-65 south near Shepherdsville.<span style="mso-spacerun: yes;">  </span>The trailer came loose from the tractor and came to a stop in the middle southbound lane of I-65 in Bullitt County, Kentucky.<span style="mso-spacerun: yes;">  </span>When the trailer came off there was no power going to the lights on the back of the trailer.<span style="mso-spacerun: yes;">  </span>Additionally no reflective tape was on the trailer.<span style="mso-spacerun: yes;">  </span>The driver had no triangles or flares to put behind him.<span style="mso-spacerun: yes;">  </span>He attempted to get the trailer re-connected to the tractor.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;">My client was driving a tractor-trailer and also headed south on I-65.<span style="mso-spacerun: yes;">  </span>He stated to me that he was driving along and he knew something was different but it just looked like there was nothing there.<span style="mso-spacerun: yes;">  </span>He compared it to a black hole.<span style="mso-spacerun: yes;">  </span>By the time he realized that there was a trailer stopped in the middle lane of the expressway he had no chance and slammed into the back of the disabled trailer.<span style="mso-spacerun: yes;">  </span>A passerby pulled him out of his flaming truck.<span style="mso-spacerun: yes;">  </span>Tragically the other driver was killed as he was between his tractor and trailer at the time.<span style="mso-spacerun: yes;">  </span>My client had hit his trailer. This tragic truck accident could have been avoided had emergency flashers, flares or reflective triangles been used. Unfortunately, none of this equipment was even in the truck. </span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>I bring this up because you never know what is going to happen on the highway.<span style="mso-spacerun: yes;">  </span>You need to be cautious and careful at all times.<span style="mso-spacerun: yes;">  I represented a client that had just been in a rear end collision. As he was walking back to the driver&#8217;s side of his car another car came flying by. Luckily his front door was open and he jumped into the front seat to avoid being hit. </span>Any disabled motorist, whether it be from a traffic automobile accident, a motorcycle accident, a truck accident, or simply a blown rod in your engine, must make themselves visible on the road.<span style="mso-spacerun: yes;">  </span>Take precautionary measures to make yourself visible to traffic.</span></span></p>

<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>7.<span style="mso-tab-count: 1;">         </span>As a bicyclists you must obey the rules of the road.<span style="mso-spacerun: yes;">  </span>Don&#8217;t ride on the sidewalks.<span style="mso-spacerun: yes;">  </span>Make sure that you are aware of what the cars are doing.<span style="mso-spacerun: yes;">  </span>Remember cars can&#8217;t see you as well as you see them. Drivers of cars need to watch out for bikes too. Remember that bikes have the same rights as cars.</span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>6.<span style="mso-tab-count: 1;">         </span>Motorcycles don&#8217;t needlessly speed and be aware of what cars are doing. When I ski I need to watch out for other skiers as well as snowboarders, who go down a hill differently then a skier. I have to be aware of this and respect the differences to avoid an accident. A driver of a car needs to have the same respect for other vehicles that are on the road.</span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>5.<span style="mso-tab-count: 1;">         </span>Avoid road rage.<span style="mso-spacerun: yes;">  </span>A calm driver is a safe driver.</span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>4.<span style="mso-tab-count: 1;">         </span>Be courteous.<span style="mso-spacerun: yes;">  </span>This goes along with No. 5. Let another car into traffic.<span style="mso-spacerun: yes;">  </span>Don&#8217;t cut them off.<span style="mso-spacerun: yes;">  </span>It won&#8217;t kill you. This goes a long way toward helping to control a driver&#8217;s temper and traffic running smoothly.<span style="mso-spacerun: yes;">  </span>Remember everyone is trying to get somewhere in a hurry and where they are getting is just as important as where you are going.</span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>3.<span style="mso-tab-count: 1;">         </span>Remember a yellow light means to stop, not speed up and try to get through the intersection.<span style="mso-spacerun: yes;">  </span>If you can stop safely you should.<span style="mso-spacerun: yes;">  </span>A yellow light only means that you should clear the intersection if you are in it. If you speed up at a yellow light sooner or later you will cause an accident.</span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>2.<span style="mso-tab-count: 1;">         </span>Make sure your car is in safe working order.<span style="mso-spacerun: yes;">  </span>Make sure the tires, brakes, etc. are all working properly. Have your mechanic check your car out. It is a lot cheaper than being in an accident.</span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>1.<span style="mso-tab-count: 1;">         </span>Drumbeat please – don&#8217;t be a distracted driver.<span style="mso-spacerun: yes;">  </span>Get off your cell phone.<span style="mso-spacerun: yes;">  </span>Don&#8217;t text.<span style="mso-spacerun: yes;">  </span>Don&#8217;t <span style="mso-spacerun: yes;"> </span>look up phone numbers.<span style="mso-spacerun: yes;">  </span>Don&#8217;t put on your makeup.<span style="mso-spacerun: yes;">  </span>Distracted Driving is the No. 1 cause of accidents in America today overtaking drunk driving (which you obviously shouldn&#8217;t do either, so we will make it 1A). I actually saw a young girl try to text and drive on the snowy roads last night on the way home. She probably ended up in a ditch some where.</span></span></p>
<p class="MsoNormal" style="margin: 0pt;"> </p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;; mso-ansi-language: EN-US; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: AR-SA; mso-bidi-language: AR-SA;">            I&#8217;m sure I could easily have a top 25 list of ways to avoid automobile accidents. I hope this gets your mind thinking on how you can avoid automobile accidents and be a safer driver on our Kentucky roads.<span style="mso-spacerun: yes;">  </span>Nobody is a winner if there is an accident.<span style="mso-spacerun: yes;">  </span>Let&#8217;s keep them to a minimum this year.</span></p>

<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">The reason I bring this up is in the Seinfeld episode during the Festivus dinner you gather your family around and you tell them all the ways they have disappointed you over the past year.<span style="mso-spacerun: yes;">  </span>This is called the airing of grievances.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;">So I thought I would air my grievances about Louisville drivers and how their actions can cause serious automobile accidents here in Kentucky.<span style="mso-spacerun: yes;">  </span>Car accidents can have severe consequences and distracted driving is even worse during the holiday season. We all have our minds on other things.<span style="mso-spacerun: yes;">  </span>Holiday road rage runs wild.<span style="mso-spacerun: yes;">  </span>Here are a few of the grievances I have against some of those drivers that use the Louisville roadways:</span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>1. <strong style="mso-bidi-font-weight: normal;">Bicyclists That Ignore the Law.</strong><span style="mso-tab-count: 1;">    </span>As I was riding to work this morning I got off the expressway at Jefferson Street.<span style="mso-spacerun: yes;">  </span>As I was driving down Jefferson Street I saw someone riding their bike to work, which I commend.<span style="mso-spacerun: yes;">  </span>The same laws of the road apply to bike riders as to cars.<span style="mso-spacerun: yes;">  </span>This particular rider, during rush hour mind you, was riding the white line of a lane in between cars. He was only giving himself a foot on either side as he went down through the traffic.<span style="mso-spacerun: yes;">  </span>This is just downright dumb.<span style="mso-spacerun: yes;">  </span>I<span style="mso-ansi-language: EN-CA;" lang="EN-CA"> hope he made it to work.<span style="mso-spacerun: yes;">  </span>The chances are if he continues this activity, he is going to be involved in a bicycle accident. He will be injured and have problems for the rest of his life.</span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small; font-family: Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>2. <strong style="mso-bidi-font-weight: normal;">Texting and driving.</strong><span style="mso-spacerun: yes;">  </span>I had someone pull over into my lane as she was texting and had no idea that it even happened.<span style="mso-spacerun: yes;">  </span>Get off the phone and concentrate on driving.<span style="mso-spacerun: yes;">  </span>It’s very simple to do and it will save your life as well as others’ lives.<span style="mso-spacerun: yes;">  </span>Is it worth being in an accident because you need to text, “Oh my gosh” to your girlfriend in the next 13 seconds?</span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small; font-family: Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>3. <strong style="mso-bidi-font-weight: normal;">Using Two Lanes to Make a Turn</strong>. Stay in your lane. Don’t make a right turn by initiating your turn toward the left. <span style="mso-spacerun: yes;"> </span>Stay in your lane.<span style="mso-spacerun: yes;">  </span>You don’t have to veer to the left and into the other lane in order to make a right-hand turn.<span style="mso-spacerun: yes;">  </span>You can do it within the lanes.<span style="mso-spacerun: yes;">  </span>That’s why the lines are there.</span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small; font-family: Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>4. <strong style="mso-bidi-font-weight: normal;">Tailgaters</strong>.<span style="mso-spacerun: yes;">  </span>Get off the rear end of my car.<span style="mso-spacerun: yes;">  </span>You’re not going to get there any quicker because you’re 5 feet off my bumper.<span style="mso-spacerun: yes;">  </span>Be three car lengths back.<span style="mso-spacerun: yes;">  </span>There is a reason this is recommended.<span style="mso-spacerun: yes;">  </span>You’re reaction time is not good enough if I have to slam on the brakes for a deer.<span style="mso-spacerun: yes;">  </span>You’re going to cause an accident and you’re going to hurt my back.<span style="mso-spacerun: yes;">  </span>Back off.</span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small; font-family: Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>5. <strong style="mso-bidi-font-weight: normal;">Icy Road Speeders</strong>. When the roads get wet and snowy, slow down.<span style="mso-spacerun: yes;">  </span>There’s no reason to go 75 miles an hour in a 45 mile per hour zone weaving in and out traffic.<span style="mso-spacerun: yes;">  </span>I know 95 percent of the road is okay, but if you hit that one spot at the wrong time you’re going to lose control and cause a serious car wreck.<span style="mso-spacerun: yes;">  </span>You don’t need to be in an accident this time of year and neither do I.<span style="mso-spacerun: yes;">  </span>Slow down, drive smart, don’t be an idiot.</span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="font-size: small; font-family: Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-ansi-language: EN-CA;" lang="EN-CA"><span style="mso-tab-count: 1;">            </span>These are just five of my grievances I have to voice against </span><span style="mso-ansi-language: EN-CA;" lang="EN-CA">Louisville</span><span style="mso-ansi-language: EN-CA;" lang="EN-CA"> drivers. I have many others. These are just some of the poor driving skills I’ve seen in the last few weeks.<span style="mso-spacerun: yes;">  </span>I know I’m somewhat making light of this, but my point is if you are careful you can save yourself from being in an accident. You don’t have to be injured. <span style="mso-spacerun: yes;"> </span>Christmas is a great time of year. <span style="mso-spacerun: yes;"> </span>Let’s all drive smart and take care of ourselves and take care of other drivers on the road so that we can eliminate bicycle accidents, car accidents and truck accidents.<span style="mso-spacerun: yes;">  </span>Have a safe and happy Festivus and let’s hope that there are no grievances to air about </span><span style="mso-ansi-language: EN-CA;" lang="EN-CA">Louisville</span><span style="mso-ansi-language: EN-CA;" lang="EN-CA"> drivers and </span><span style="mso-ansi-language: EN-CA;" lang="EN-CA">Kentucky</span><span style="mso-ansi-language: EN-CA;" lang="EN-CA"> car accidents in the coming year.</span></span></span></p>

Another thing that comes with the holiday season is downright stupid driving.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;">I was driving down US 42 on the way to work and a car swerved over into my lane and almost ran me off the road.<span style="mso-spacerun: yes;">  </span>I looked over only to see a teenage girl, texting on her phone, totally unaware that she had almost caused an accident.<span style="mso-spacerun: yes;">  </span>I honked at her, which I probably shouldn&#8217;t have done. I then gave her the universal signal for “What were you thinking?” (Both hands extended in the air) She looked over at me with a puzzled look on her face and then went straight back to texting and driving.<span style="mso-spacerun: yes;">  </span>She is a ticking time bomb; eventually she will be involved in an automobile accident. I hope no one is seriously injured.</span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small;"><span style="font-family: Times New Roman;">I know inattentive driving is not limited to Christmas time. But this close call made me think that we need to be much more aware of what is happening on our roads in Louisville, Kentucky, in order to avoid an automobile accident.<span style="mso-spacerun: yes;">   </span>There are always people that are not thinking clearly while they are driving. They text, eat, read, put on make up, and on and on. Distracted drivers are dangerous. You have seen this as you drive down the road. <span style="mso-spacerun: yes;"> </span>I saw a bicycle on the road in this cold weather without any reflectors and the rider was dressed totally in black and it was night and pitch black.<span style="mso-spacerun: yes;">  </span>I hope he made it home.<span style="mso-spacerun: yes;">  </span>It would be a minor miracle.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt; line-height: 200%;"><span style="font-size: small; font-family: Times New Roman;">As we get closer and closer to Christmas, tempers are going to flare as shoppers are trying to get to the malls. We will all rush out to get that last minute gift. I urge everyone to be <span style="mso-spacerun: yes;"> </span>extra careful during this time.<span style="mso-spacerun: yes;">  </span>Be a little more cautious.<span style="mso-spacerun: yes;">  </span>Take a little more time.<span style="mso-spacerun: yes;">  </span>Try not to be in a hurry.<span style="mso-spacerun: yes;">  </span>I know that this is a hard task, but we need to look out for the other car. If you don’t you are risking being in a serious auto accident.<span style="mso-spacerun: yes;">  </span>You need to expect the unexpected.<span style="mso-spacerun: yes;">  </span>Just because you have a green light does not mean the other person will be paying attention.<span style="mso-spacerun: yes;">  </span>Look as you go through to make sure that the other person sees the red light.<span style="mso-spacerun: yes;">  </span>You need to have your escape route planned.<span style="mso-spacerun: yes;">  </span>Don&#8217;t let a car wreck destroy your Christmas holiday.<span style="mso-spacerun: yes;">  </span>Be aware that people are not paying as much attention. You must pay twice as much attention to have a safe and accident free holiday season.</span></p>

It is obvious.<span style="mso-spacerun: yes;">  </span>In Kentucky we now have a <a href="http://www.courier-journal.com/article/20091102/NEWS01/911020360/Simulator+shows+danger+of+texting+while+driving">simulator which demonstrates the dangers of texting and driving</a>. The simulator can be requested from the Office of Highway Safety and is free to the schools.<span style="mso-spacerun: yes;">  </span>It has not been used in Jefferson County but I hope our schools will take advantage of the program.<span style="mso-spacerun: yes;">  </span>This new program has been developed to demonstrate the problems and many dangers of texting and driving to high school students.<span style="mso-spacerun: yes;">  </span>This is presented for no charge by the Kentucky office of Highway Safety.<span style="mso-spacerun: yes;">  </span></span></span></p>

<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">Individuals are strapped into an arcade-type racing game.<span style="mso-spacerun: yes;">  </span>The simulator has a seat equipped with a seatbelt, a gas pedal and a brake pedal.<span style="mso-spacerun: yes;">  </span>There is also a steering wheel and a gearshift. You have three screens in front of you that gives the operator an 180?degree view of a roadway. The driver is requested to operate or drive normally. They are then handed a cell phone and asked to send a text message while they can continue to drive the simulator.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small; font-family: Times New Roman;">When they are handed the cell phone it usually sends the car swerving into another lane.<span style="mso-spacerun: yes;">  </span>Drivers are allowed to watch a replay of their simulation. When students are shown the simulation replay they see themselves swerving when they thought they were actually driving okay.<span style="mso-spacerun: yes;">  </span>Distracted driving has become the leading cause of crashes among 16 to 21 years old.<span style="mso-spacerun: yes;">  </span>Texting and driving is a big, big part of this.<span style="mso-spacerun: yes;"> </span></span><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="mso-tab-count: 1;"><span style="font-size: small; font-family: Times New Roman;">            </span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;"><span style="mso-tab-count: 1;">            </span>The US Department of Transportation has <a href="http://bangkokpost.com/auto/autoscoop/25859/putting-the-20-brakes-on-distracted-drivers">banned all federal employees</a> from texting and driving on federal-issued or personal phones while in vehicles owned by the federal government or in vehicles being used on federal business.<span style="mso-spacerun: yes;">  </span>This includes the military.<span style="mso-spacerun: yes;">  </span>Although the federal government may be the most recent, the National Safety Council indicates that hundreds of private companies and organizations have banned the use of cell phones while driving to reduce accidents at work.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">This needs to be the law in Kentucky and should be the number one priority at the next Kentucky legislative session.<span style="mso-spacerun: yes;">  </span>The word is getting out in Kentucky partly thanks to <a href="http://www.wlky.com/news/21300499/detail.html">Nicole Meredith</a>, who is a teen.<span style="mso-spacerun: yes;">  </span>She wrecked her car on the Gene Snyder last summer when she was texting a friend.<span style="mso-spacerun: yes;">  </span>As she was texting she went off the road and totaled her car.<span style="mso-spacerun: yes;">  </span>Miraculously she walked away from the crash without injuries.<span style="mso-spacerun: yes;">  </span>Meredith has told her story in Frankfort to help kickoff the Transportation Department&#8217;s distracted driving campaign.<span style="mso-spacerun: yes;">  </span>Hopefully there will be more than just a campaign and soon no text messaging behind the wheel will be the law in Kentucky.<span style="mso-spacerun: yes;">  </span></span></span></p>

<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">Believe it or not there were 53,000 distracted driving-related crashes last year in Kentucky.<span style="mso-spacerun: yes;">  </span>Link Kentucky kicks off campaign to cut down on distracted driving.<span style="mso-spacerun: yes;">  </span>Governor Steve Beshear is considering a policy that would limit distracted driving for all state employees.<span style="mso-spacerun: yes;">  </span>Do we really need to have to tell them that it&#8217;s time to make this the law?<span style="mso-spacerun: yes;">  </span>I hope Kentucky follows suit with Colorado. Their new law dictating how you use your cell phone while driving takes effect December 1, 2009.<span style="mso-spacerun: yes;">  </span>After this date no one under the age of 18 will be allowed to talk on a phone while driving.<span style="mso-spacerun: yes;">  </span>Everyone will be banned from texting while driving.<span style="mso-spacerun: yes;">  </span><span style="mso-spacerun: yes;">  </span></span></span></p>

This will help to precent car accidents on our Kentucky roads.</span></p>

			<content:encoded><![CDATA[<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">I was driving my 16 year old daughter to school this morning.<span style="mso-spacerun: yes;">  </span>She has her driver&#8217;s permit and is learning to drive and is very excited about it.<span style="mso-spacerun: yes;">  </span>She told me that there was a program on Channel 1 at her high school here in Louisville that was preempted by the school.<span style="mso-spacerun: yes;">  </span>For those of you that are not familiar with Channel 1, it is a national news program that is shown in high schools. My daughter’s school felt that the content was too graphic.<span style="mso-spacerun: yes;">  </span>So what does a sixteen year old do if her school tells her she can’t watch a video because it is too graphic? She gets on the computer and performs a search on YouTube and was and finds the program.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">The preempted program is a community awareness ad from the United Kingdom depicting the dangers of text messaging and driving by teenagers.<span style="mso-spacerun: yes;">  </span>I have to admit that it was very graphic.<span style="mso-spacerun: yes;">  </span>It showed three teenage girls driving down the road while using a phone to send a text message to a friend.<span style="mso-spacerun: yes;">  </span>They were driving and paying more attention to the phone then to the road. Their car went across the center line and struck another car head-on. The airbags deployed. <span style="mso-spacerun: yes;"> </span>Heads hit the windshield. There was blood everywhere. As the car came to a stop it was T-boned by another car. One girl died in the lap of the driver.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small; font-family: Times New Roman;">It went on to show the families in the other cars. <span style="mso-spacerun: yes;"> </span>There was a toddler who kept asking; “Why won&#8217;t mommy and daddy wake up?” A child in a car seat was also shown motionless with eyes wide open, obviously dead.</span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="mso-spacerun: yes;"><span style="font-size: small; font-family: Times New Roman;"> </span></span></p>
<p class="MsoNormal" style="margin: 0pt; text-indent: 36pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">Although it was quite graphic I disagree with the school&#8217;s decision to pull this informational video. Teenagers who are new drivers generally have no idea as to what the real dangers that driving a car entails and how text messaging behind the wheel can affect not only their life, but the lives of others.<span style="mso-spacerun: yes;">  </span>I don&#8217;t believe that most teenagers have a true understanding of the real dangers of driving a car. My old boss at the Commonwealth attorney&#8217;s office, Ernie Jasmine used to refer to an automobile with a drunk driver behind the wheel as a 2-ton projectile with a license to kill.<span style="mso-spacerun: yes;">  </span>I believe he would have referred to a driver who is texting in the same way. Teen drivers need to be shown that a car is a very dangerous weapon that can kill people and change their lives forever.<span style="mso-spacerun: yes;">  </span></span></span></p>

			<content:encoded><![CDATA[<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;">One of the worst things an accident victim can do is fake an injury or exaggerate the injuries they did receive.<span style="mso-spacerun: yes;">  </span>Unfortunately this is a practice many do in hopes of getting a better settlement.<span style="mso-spacerun: yes;">  </span>Because of these practices the insurance industry has long resorted to video surveillance to catch these culprits.<span style="mso-spacerun: yes;">  </span>Some critics feel that these practices have gone too far when the insurance video tapes truly disabled people and using the videos against them. The sad part is these “scam artists” make the process a nightmare for those Kentucky accident victims that were truly injured in an auto accident.</span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;">I recently read about a case in point, <a href="http://abcnews.go.com/GMA/YourMoney/disabled-man-hartford-stopped-insurance-benefits-surveillance/story?id=9054265">Jack “Rocky” Whitten</a>. Mr. Whitten suffers from several residual symptoms as a result of a broken neck from a fall.<span style="mso-spacerun: yes;">  </span>He has vision problems, memory issues and is often in excruciating pain.<span style="mso-spacerun: yes;">  </span>Mr. Whitten fortunately had purchased disability insurance ten years ago that would pay him 60 % of his salary if he ever became disabled. After his fall three doctors declared him permanently disabled and he began receiving benefits in 2003.</span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;">Last year a representative from Hartford Insurance Company visited Mr. Whitten and his wife and questioned his limitations. The claims adjuster then pulled out a video that showed Mr. Whitten getting out of a van, looking at a magazine, and eating chips and salsa.<span style="mso-spacerun: yes;">  </span>Maybe you are reacting like I did and are saying “So what?” Shortly after this visit the Whitten’s received a letter from Hartford explaining that his benefits would be cut off based on the video and a report from a doctor hired by Hartford –who had never examined Mr. Whitten- that claimed he, was able to work based on the video. After a phone call from national television show <strong style="mso-bidi-font-weight: normal;"><em style="mso-bidi-font-style: normal;">Good Morning America</em></strong> Mr. Whitten’s benefits were restored. <a href="http://abcnews.go.com/GMA/YourMoney/statement-hartford/story?id=9068038">Hartford believes </a>this claim has been handled fairly and strongly.</span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;">This process a doctor looking at records and not examining the patient is called a “Peer Review”. It is a common practice in cases and is frequently used in Kentucky car accident cases to review medical payments submitted under PIP. The medical care is often found to be unnecessary or unrelated to the car wreck by the peer review doctor. The insurance company will deny payment based on this “paper review’. This forces the accident victim to litigate their case against the car that caused the accident and their own insurance company. The process is very frustrating to those accident victims who have legitimate injuries. Many times those unrepresented by an attorney will stop treating which is detrimental to their claim and recovery. </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0pt;"><span style="font-size: small; font-family: Times New Roman;">Insurance companies have been using video surveillance tactics for years. I have seen this in Kentucky cases. I have watched videos of accident victims painting houses and dancing. In our new internet world insurance companies have also become cybersleuths. The internet has an abundance of information that is available to them by looking at Facebook, Myspace, YouTube, etc. Don’t give them<span style="mso-spacerun: yes;">  </span>a reason to deny your claim. Be careful. As we can see from Mr. Whitten, even the most innocent action will be misinterpreted.</span></p>
